Instructions and Help about Foia request online

To get information under the FOIA typically you must make a FOIA request now this is a written request in which you describe the information you want and the format you want it in in as much detail as possible you should be aware that the FOIA does not require agencies to do research for you to analyze data or answer written questions or to create records in response to your request finally you should know that the FOIA requires that federal agencies release certain information automatically without the need for you to make a request so before you send in that FOIA request it's a good idea to look at agency websites first and see what's already available online.

FAQ - Foia request online

Can you get (in the U.S.A) police reports from 25+ years ago? Are they posted online? I always wanted to find out why my creepy neighbor got arrested when I was a kid. I found the record online. It doesn't give any details.
Okay, police reports aren't posted online that I know of. Police records, such as dispatch transcripts, narrative reports, etc., can generally be requested from the police agency that handled the arrest by submitting a request for records to the Department's records clerk or other such administrative personnel. If you go to the Department's website u2023 which, depending on the size of the jurisdiction where the incident occurred, may just be part of the city's website as opposed to the Department having its own web address u2023 you may be able to find a form you can fill out and submit online to request the records you want. They should also have instructions for submitting your request through the mail if you prefer to handle your request offline. If you don't particularly care about the police records and you just want to know what your creepy neighbor got in trouble for, you should be able to find the specific reason for the conviction (assuming there was one) by searching court records online. If Creepy went to prison, you may be able to find information about his/her sentence by googling u201c[your state] Department of Corrections inmate searchu201d and then typing Creepyu2019s name into the search bar. If Creepy is still in prison, make sure the u201cactiveu201d box is ticked. If not, make sure the u201cinactiveu201d box is ticked. Then just find Creepy in the search results (mugshots should display next to names). Clicking the link will pull up basic information on them (age, height, hair color, eye color, weight, etc.) as well as sentence information, including what the specific conviction(s) was/were for, length of sentence, disciplinary infractions, work program information, projected release date, outstanding detainer warrants out of other jurisdictions, current location, previous location (if moved from one prison facility to another at any time during incarceration), and whether or not they're eligible for parole, and if so, when.If they were/are in federal prison, you'll have to search the federal database (u201cunited states/federal dept of corrections inmate searchu201d) and I don't know what information they provide, if any, but Iu2019m assuming it's the same or similar, if it exists at all. I'm sure it does, but I've never personally seen or tried to use it, therefore, to borrow a phrase from the CIA, I can neither confirm nor deny its existence.Bear in mind that if they are/were in protective custody (child molesters and u201csnitches,u201d are some examples of people who tend to be in PC) their information may not be available to the public online. In that case, you may be able to request Creepyu2019s info from the prison, but I have no idea if they would even entertain such a request. They might, I dunno. If you can't find anything online, the police department doesn't have a formal records request process or your request is denied, or the arrest never resulted in a conviction/Creepy had his/her criminal record expunged but you still want information on the incident itself, you can submit a records request in writing to the police department under the Freedom of Information Act. If the records do still exist after 25 years, this should yield satisfactory results if all else fails. If you do submit a FOIA request, there are a couple things to keep in mind. First, you're required to include your contact information (name, address, email, telephone number) with your request. You also have to specify how you would like to receive the records youu2019re asking for (electronically via email, hard copies in the mail, etc.) You must also specify which records you're seeking, and you must describe them thoroughly enough that the records clerk or other such administrative personnel will be able to locate them without having to guess at what the hell you're talking about. If you're too vague, that can be grounds for a denial since they won't know what they're supposed to send you. You also have to specify whether or not the request is being made for commercial purposes, because it affects which fees are applicable.Donu2019t worry, writing a FOIA request isnu2019t as much of a pain in the ass as it sounds. See below for a basic FOIA template. To Whom It May Concern:This is a request for records under the Freedom of Information Act. I hereby request the following records:Any and all documents or police files mentioning [Creepy Neighboru2019s full name] arising from [incident #], which occurred on [date] at [address/location of arrest, if you know it].These records [will/will not] be made available to the public, and this request is not being made for commercial purposes. In the event there are fees, please notify me of the total charges in advance of fulfilling this request. I prefer to receive the requested records [electronically via email/in writing through the mail].Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving the requested items within 20 business days, as required by the statute.Sincerely,[Your Name]If they don't respond to your request within 20 business days, you can technically sue them. If they respond with a denial, they must cite a specific reason for the denial and instructions on how you can appeal the decision. They may also respond with a request for additional time in fulfilling your request. If the records don't exist because it's been too long, you can submit the same request to the court that had jurisdiction over the case, assuming charges were officially filed by the District Attorneyu2019s office at the time.Hope this helped!
What are some tips for submitting a successful FOIA request?
In the USA, if you do a websearch of whatever agency or government subdivision it is that you wish to FOIA, almost all (I believe all, but I am hedging my language.) will have instructions on how to submit a Freedom of Information Act request. Many entities make it possible to file a request online. It is not rocket surgery. When submitting a FOIA request, be as specific as possible with locations, time frames and types of documents, give background information and descriptions of what you are searching and, if possible, why you want it.Not every person working on the responses is trying to frustrate you or stonewall you or hiding things.
How do I respond to a request for a restraining order? Do I need to fill out a form?
As asked of me specifically,The others are right, you will likely need a lawyer. But to answer your question, there is a response form to respond to a restraining order or order of protection. Worst case the form is available at the courthouse where your hearing is set to be heard in, typically at the appropriate clerk's window, which may vary, so ask any of the clerk's when you get there. You only have so many days to respond, and it will specify in the paperwork. You will also have to appear in court on the date your hearing is scheduled. Most courts have a department that will help you respond to forms at no cost. I figure you are asking because you can't afford an attorney which is completely understandable. The problem is that if you aren't represented and the other person is successful in getting a temporary restraining order made permanent in the hearing you will not be allowed at any of the places the petitioner goes, without risking arrest.I hope this helps. Not given as legal advice-

If I filed a police report over the phone, then how can I get the actual report in paper form?
You can call them back and ask for a copy, they may send it to you through mail, email or fax. Most likely you will need to submit a FOIA (Freedom of Information Act) request. Some agencies allow FOIA requests to be submitted online, if not then you can do it through mail or show up in person and fill out the form. Also, most police departments do not fulfill FOIA requests for active investigations so you will likely have to wait until the case is closed in court or until the police are finished with their part.
